1. The service
Order Elite provides staff workflows for RMAs, replacements, reships, add-on sales, manual orders, payment requests, shipping selections, linked history, and fulfillment handoff. Available features depend on the merchant's plan, Shopify capabilities, granted permissions, store configuration, and connected services.
2. Merchant account and responsibilities
The merchant must maintain an eligible Shopify account, give access only to authorized staff, protect credentials, configure its store and integrations correctly, and ensure staff have authority to create orders, request payments, alter shipping charges, and process personal information.
The merchant is responsible for reviewing each order, amount, address, shipping service, tax identifier, payment state, and fulfillment instruction. Order Elite records customer-provided tax IDs but does not validate them, determine tax treatment, guarantee carrier rates, or replace the merchant's obligations to buyers, carriers, customs authorities, tax authorities, or payment providers.
3. Acceptable use
Merchants and authorized users may not use the service unlawfully or fraudulently; bypass authentication, tenant boundaries, billing, payment gates, or safety controls; disrupt or overload the service; upload malicious code; misuse customer data; misrepresent tax, customs, price, payment, or fulfillment status; or grant access to an unauthorized person.
4. Subscriptions, cancellation, and refunds
Current plans, billing intervals, included usage, trials, and prices appear on the pricing page and in Shopify's approval flow. Paid Order Elite plans are offered and billed only through Shopify App Pricing or Shopify's app billing system. Order Elite does not use an external checkout for app subscription fees. Cancellation and refund terms appear on the billing, cancellation, and refunds page.
5. Third-party services
Shopify, carriers, fulfillment platforms, payment providers, and merchant-enabled services operate under their own terms. Order Elite may depend on their APIs, data, availability, rates, permissions, and configuration. FIRGELLI Automations is not responsible for third-party outages, carrier performance, payment decisions, or data a merchant directs another service to process.
6. Merchant content and feedback
The merchant retains its rights in store and customer information and grants FIRGELLI Automations the limited rights needed to host, process, transmit, and protect that information while providing Order Elite. Feedback may be used to improve the service without identifying the merchant or its customers without permission.
7. Intellectual property
Order Elite, its software, branding, documentation, and related materials belong to Firgelli Automations Inc. or its licensors. A valid subscription grants the merchant a limited, non-exclusive, non-transferable right for authorized staff to use the service during the subscription term.
8. Data and privacy
Personal information is handled under the Order Elite privacy policy and data processing terms. The merchant remains responsible for its own privacy notices, lawful instructions, and data-handling obligations.
9. Availability and changes
We work to keep Order Elite reliable and secure, but uninterrupted operation is not guaranteed. We may maintain, improve, limit, suspend, or discontinue a feature where needed for security, law, Shopify requirements, or service operation. We provide reasonable notice when a material change allows it.
10. Warranty disclaimer
To the extent permitted by law, Order Elite is provided “as is” and “as available.” FIRGELLI Automations disclaims implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranty that every third-party service or merchant workflow will remain available or error free.
11. Limitation of liability
To the extent permitted by law, FIRGELLI Automations is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, or business interruption. Aggregate liability arising from Order Elite will not exceed the fees the merchant paid for the service during the twelve months preceding the event that gave rise to the claim. These limits do not apply where law prohibits them.
12. Suspension and termination
A merchant may stop using Order Elite and uninstall it at any time. FIRGELLI Automations may suspend or terminate access for material breach, non-payment, unlawful use, security risk, or a platform requirement. Provisions that by their nature should survive termination remain in effect.
13. General terms
Neither party is liable for delay caused by events beyond reasonable control. The merchant may not transfer these terms without written consent except as part of a permitted business reorganization. If one provision is unenforceable, the remaining provisions stay effective. A signed order form or enterprise agreement controls if it conflicts with these terms on the same subject.
14. Contact
